Presenters will utilize real world examples and experience to discuss the benefits, risks, solutions, and trends relating to Artificial Intelligence (AI) from multiple perspectives. The speakers will discuss the various legal, business, and other benefits and risks associated with the current uses of AI, potential solutions to avoid those risks, and the trends they see as the use of AI grows.

9:40 – 10:40 a.m. – Navigating the First 24 to 96 Hours: A Comprehensive Insight Into Incident Response and Materiality Reporting in Cybersecurity

Hear from industry thought leaders with extensive experience about common issues in organizational incident response. The gap between organizations’ eventual performance and the performance they could have achieved if they had a better grasp on the realities of what is involved in managing and executing incident response is often considerable. While they often finally “get it,” during the time it took for them to mature their processes to a functional capability, considerable time is lost and damage is done, both by the attacker and the responders.

Discussion will include examples of incident response gone wrong and what happens when handled correctly, as well as identifying and reporting a material cybersecurity incident under the SEC Cybersecurity Rules. Delving into the first 96 hours of a cyber incident where legal decisions and technical performance will determine the success or failure of a cyber incident response. Specific topics that will be discussed include:

  • Importance of competent legal involvement in incident response
  • Identification of common technical and business/legal workstreams.
  • Incident tracking and status updates, including initial severity determination
  • Determining whether a cybersecurity incident is material
  • Lesson (not) learned from prior engagements.

About our speakers

Melissa K. Ventrone is on the cutting edge of data security and privacy, helping clients navigate emerging challenges related to today’s digital economy. As leader of the Cybersecurity, Data Protection, and Privacy practice, Melissa directs her skilled, multidisciplinary team of first responders to minimize security risks, ensure regulatory compliance, and curtail damage in the event of a data incident.

Chetan Bhatia is a Managing Director of Cyber Resilience and Engagement Management within Aon Cyber Solutions Global practice (formerly Stroz Friedberg). In this role he is responsible for helping clients all over the world proactively manage cyber and enterprise risk and leads digital forensics, cybercrime, data breach, financial crime, compliance, electronic discovery and business intelligence and investigations matters.

Peter Berk is a skilled advisor, assisting clients to prevent, prepare for, and deal with legal issues and litigation that arise in today’s technology-driven world. He has handled disputes and litigation involving data breaches, privacy torts, on-line infringement, cybersquatting, defamation, state Consumer Fraud Act claims, and violations of the Computer Fraud and Abuse Act and Stored Communications Act, amongst others.

Ted Ganchiff is the founder of Genubi.ai, an early-stage conversation analytics startup focused on unlocking the immense power of on-location conversation data via AI. Genubi delivers first-ever data insights to drive innovation and revenue growth for companies that operate in physical locations.

Kevin Kalinich is the founder of Aon’s Cyber Solutions Group, and leads Aon’s global practice to identify exposures and develop insurance solutions related to intangible assets, including intellectual property, technology errors and omissions, miscellaneous professional liability, media liability and coordination of multiple lines of insurance related to cyber perils and digital assets, such as artificial intelligence, blockchain, IoT/5G, crypto, NFT’s, quantum computing, FinTech/Defi, robotics and metaverse/Web3 related issues.

Randy Stone is a Director within the Stroz Friedberg Digital Forensics and Incident Response (DFIR) Practice.  In this role, he has led and investigated some of the most complex and sensitive large-scale incidents and forensics matters conducted by Stroz Friedberg, managing incident response, and conducting digital forensics analyses of digital media.  He works on various matters, including corporate investigations, nation-state intrusion investigations, ransomware response involving investigation, incident, and restoration management, persistent threat, and data recovery investigations.

Patrick E. Zeller. As the Chief Privacy Officer, Information Governance, and Cyber Security Counsel at Amgen (Formerly Horizon Therapeutics), Patrick leads the company’s global privacy and information governance office. Patrick has 15 years of experience leading global privacy programs for Fortune 100 companies. Before joining Horizon, Patrick served at Abbott Labs as the DVP of Global Privacy and as the Enterprise Privacy Officer at Gilead Sciences. Additionally, Patrick supported Europe, Canada, APAC, and Latin America for Information Governance, Records, eDiscovery, and Privacy.  He is a former litigator and federal computer crimes prosecutor.
